California Law Funeral Arranger Practice Exam

A guaranteed funeral cost claim is valid only when the promise is truthful and anchored in written contract terms, with any necessary disclaimers clearly stated. When a home or funeral provider offers a price guarantee, it binds itself to a specific amount for a defined set of goods and services and must spell out exactly what is included, the time frame the price holds, and any conditions that could change the price (such as substitutions, omissions, or added services). This written basis not only supports enforceability but also protects the consumer by providing a clear, verifiable agreement of what is promised.

Verbal assurances alone don’t meet this standard because they lack the documented terms that define scope, exclusions, and duration. If the guarantee were allowed to be misleading or vague, it wouldn’t serve as a reliable protection for consumers. It’s also inappropriate to imply the guarantee applies only to some services unless the contract precisely specifies that limited scope. Disclaimers are often necessary to outline exceptions or conditions, ensuring both sides understand when the guarantee does and does not apply.
